This Privacy Policy (“Privacy Policy”) explains AU Energy, LLC’s (“we,” “us,” “our”) privacy practices for the personal information described herein. This Privacy Policy applies any time that we collect personal information from or about individuals, including personal information collected through our websites, software, and mobile applications (collectively, “Sites”) and any of our online and offline services (each a “Service” and collectively, the “Services”).
The Privacy Policy may be revised from time to time. The “Last Updated” legend at the bottom of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on any of our Sites or Services.
PERSONAL INFORMATION WE COLLECT
We may collect personal information and the personal information we collect will vary depending on your interaction with us and which Service you use. Personal information is information that is linked or reasonably linkable to an identified or identifiable individual. We collect personal information in multiple ways:
Personal Information You Provide to Us: Depending on how you interact with our Sites and Services, we will collect personal information you provide to us for the following purposes:
- Create an Account or Sign Up for Our Loyalty Program. To create an account or sign up for our loyalty program, you will provide us with your name, phone number, and email address. Through your account and/or our loyalty program, we will collect your purchase information and date of birth. When you create an account, you may be asked to create a username and password for future login purposes.
- Place an Order. To place an order for pick up, you will provide us with your name, email address, phone number, and payment information. We use Stripe, a third-party vendor, to process car wash-related purchases. For more information about how Stripe processes your personal information, please review its privacy policy here.
- Find a Store. To find a store location, you will provide us with your zip code or location information.
- Vendor Inquiry or Collaborate. To make an inquiry about becoming a vendor or to collaborate with us, you will provide us with your name and email address, and any other information you choose to provide in your message to us.
- Register For or Attend an Event, Enter into Promotions or Contests. To register for or attend an event, or enter into a promotion or contest, you will provide us with your name, email address, and phone number.
- Contact Us. To contact us, you will provide us with your name, email address, and phone number. You may also choose to provide us with your company information, physical address, and any other information you choose to provide in your message to us.
Personal Information We Collect from Other Sources: We may collect personal information about you from a variety of sources. For example, we may obtain personal information about you from:
- state and federal government agencies;
- credit bureaus;
- social media networks when you tag us in posts, comment on our posts, or grant permission to access your data on one or more networks;
- service providers who collect information on our behalf, such as Paycom which processes applications for employment with us; and
- publicly available sources and data suppliers from which we obtain data to validate or supplement the information we hold.
Information We Collect Automatically: When you use our Services (i.e. visit our Sites or use applications that run on mobile devices or tablets), we may collect some personal information automatically through our use of cookies. For example, when you visit our Sites, we may collect device, usage and log information such as your computer’s operating system, Internet Protocol (IP) address, access times, browser type and language, the search engine you used to locate the Sites, and the website you visited before or after our Sites. In addition, we gather certain navigational information about where you go on our Sites to help us determine which areas of the Sites are most frequently visited and to help us tailor the Sites to the needs and interests of our online visitors. If you use our mobile applications or use our Services on a mobile device or tablet, we may also collect your device type, mobile phone number, operating system type, wireless carrier, and device IDs, on our mobile applications. HOW WE USE PERSONAL INFORMATION
In addition to the purposes stated above, we may use your personal information to:

We may also use personal information we have collected and aggregated, or anonymized personal information received from third parties, to understand more about our users (for example, we may use aggregated information to calculate the percentage of our users who have a particular telephone area code). This includes demographic data, inferred commercial interests, and other information we may collect from you or from third parties.
HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose your personal information with the third parties described below.
Service Providers. We may disclose your personal information with third parties who work on behalf of, or with, us such as vendors, processors, suppliers, agents, attorneys, management companies, staffing companies, and representatives (collectively, “Service Providers”). Service Providers assist us with a variety of functions including, but not limited to, staffing and employment, sending marketing communications, assisting with advertising and related analytics, delivering packages, scheduling and performing maintenance, providing management services, conducting research or surveys, sending regular mail and e-mail, maintaining databases, or processing credit card payments.
Government Agencies. We may disclose your personal information with government agencies, law enforcement, or Authorized Third Parties in response to a request relating to a civil or criminal investigation or other alleged illegal activity (collectively, “Government Agencies”).
Disclosures Under Special Circumstances. We may disclose your personal information to third parties: (i) where we have a good faith belief that such disclosure is necessary to meet any applicable law, regulation, legal process or other legal obligation; (ii) when we believe disclosure is necessary to protect or prevent harm, illegal activity, or financial loss; (iii) to detect, investigate and help prevent security, fraud or technical issues; (iv) to enforce our Terms of Use, and (v) to cooperate with law enforcement, government, quasi-governmental and public agency requests or reporting requirements.
Corporate Transactions. We may transfer your personal information in the event we: (i) sell or transfer, or are considering selling or transferring, all or a portion of our business or assets; or (ii) are considering or engaging in any reorganization, conversion, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our ownership interest, business or operations.
With Your Consent or At Your Direction. We may disclose your personal information with third parties whenever you consent to or direct such sharing. These third parties are referred to as “Authorized Third Parties” in this Privacy Policy.
PERSONAL INFORMATION OF CHILDREN
We do not knowingly collect or store any personal information from anyone under the age of 13. If we become aware that we have collected or stored personal information from an individual under age 13, we will remove his or her personal information from our files. OPT-OUT PREFERENCE SIGNALS
We engage in “sales,” “shares,” or “targeted advertising” as those terms are defined under applicable laws. Therefore, our Sites treat certain browser or device-level opt-out preference signals such as the Global Privacy Control (“GPC”) signal, as a valid request to opt out to the extent required by applicable law. We do not collect or respond to Do Not Track signals and our Sites do not function differently based on any Do Not Track preferences that may be received.
COOKIES AND OTHER TECHNOLOGIES
Like most companies, we use technologies such as web beacons, pixels, tags, and JavaScript, alone or in conjunction with cookies, to gather this information (“Cookies”). When you visit our Sites, we, or a third party, place or recognize a Cookie on your browser (including through use of pixel tags) that collects information, including personal information, about your online activities over time and across different sites.

Right to Request Deletion of Personal Information
You have the right to request that we delete any Personal Information about you that we have collected or that we maintain.
Right to Not Be Discriminated Against
You have the right not to receive discriminatory treatment from us for the exercise of the privacy rights conferred by the CCPA and listed in this CCPA Privacy Notice.
Exercising Your CCPA Rights
Submitting a Request to Know or Request to Delete. You may submit a Request to Know or a Request to Delete by contacting us at 1-833-HEY-LOOP, or by using this interactive webform.
Verification Methods. Once you submit a request, we will verify that you are the consumer to which the request pertains by matching data points that you provide with information we maintain. Depending on the type of request you submit, we will attempt to match either two or three of the data points you provided. If we are unable to verify your request with the data points you provided, we may reach out to you for additional information to verify your request.
Authorizing an Agent to Exercise Your Rights
California consumers have the right to designate an authorized agent to exercise their CCPA rights. To designate an authorized agent, you must either provide the agent with an executed power of attorney or provide the authorized agent with written permission, signed by you, to exercise your CCPA rights. The agent must also be registered with the California Secretary of State.
